1. Acceptance of Terms & Agreement

By accessing, downloading, installing, and using the Testus mobile application (iOS and Android versions), website, and all related services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services. These terms constitute a legally binding agreement between you and Testus.

2. Service Description & Platform Overview

Testus is a digital platform that facilitates connections between clients seeking care services and verified caretakers. Our services include:

• Caretaker Browsing: Search and filter verified caretakers based on qualifications, experience, and location
• Lead Creation: Post care requests and receive quotes from multiple caretakers
• Direct Contact: Unlock caretaker contact details for direct communication (₹1,999)
• On-Call Services: Request immediate care services including Full Shift (₹500-1000), Bathing (₹300-500), and Injection services (₹200-400)
• In-App Chat: Direct messaging with caretakers
• Payment Processing: Secure payment handling through Razorpay
• Ratings & Reviews: Rate and review caretakers based on your experience

Important Disclaimer: Testus is a marketplace platform. We facilitate connections but are not responsible for the quality, timeliness, or legality of services provided by caretakers. We do not employ caretakers; they are independent service providers.

3. User Eligibility & Account Requirements

To use Testus, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Provide accurate, current, and complete information
• Maintain the confidentiality of your account credentials
• Be responsible for all activities under your account
• Not create multiple accounts without authorization
• Comply with all applicable laws and regulations

4. User Responsibilities & Conduct

You agree to use Testus only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the platform. Prohibited behavior includes:

• Providing false, misleading, or fraudulent information
• Harassing, threatening, or abusing other users
• Engaging in discriminatory behavior based on protected characteristics
• Attempting to bypass security measures or access unauthorized areas
• Uploading malware, viruses, or harmful code
• Scraping, crawling, or automated data collection
• Impersonating other users or misrepresenting your identity
• Engaging in illegal activities or services
• Violating intellectual property rights
• Spamming or sending unsolicited communications

5. Payment Terms & Conditions

5.1 Payment Processing

• All payments are processed securely through Razorpay
• By initiating a payment, you authorize us to charge your selected payment method
• You are responsible for maintaining accurate payment information
• We accept Credit Cards, Debit Cards, UPI, Digital Wallets (PayTM, PhonePe, Google Pay), and Net Banking
• All transactions are in Indian Rupees (INR)

5.2 Pricing & Fees

• Contact Unlock: ₹1,999 - Unlock caretaker phone number and direct contact details for direct communication and negotiation
• Full Shift Service: ₹500-1000 - Full-time care service (typically 8-12 hours)
• Bathing Service: ₹300-500 - Personal hygiene and bathing assistance
• Injection Service: ₹200-400 - Medical assistance and injection administration
• Prices are subject to change without notice
• Additional charges may apply for emergency services or special requests
• Taxes and applicable charges will be displayed before payment confirmation

5.3 Payment Authorization

By clicking "Pay" or "Confirm," you authorize Testus and Razorpay to process your payment. You acknowledge that:

• You have sufficient funds or credit available
• The payment information provided is accurate and authorized
• You are not using stolen or fraudulent payment methods
• You understand the charges and agree to pay them

6. Intellectual Property Rights

All content on the Testus platform, including text, graphics, logos, images, and software, is the property of Testus or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or transmit any content without our prior written permission.

7. Limitation of Liability & Disclaimers

Testus is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties including:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, completeness, or reliability of content
• Uninterrupted or error-free service

Limitation of Damages: In no event shall Testus be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Testus, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms & Conditions
• Your use of the platform
• Your disputes with other users
• Your violation of any applicable law or regulation

9. Caretaker Verification & Background Checks

Testus conducts background checks and verification for caretakers, including:

• Identity verification through government-issued documents
• Criminal background checks
• Credential verification
• Reference checks

Disclaimer: While we make reasonable efforts to verify caretakers, we cannot guarantee the accuracy of all information or the absence of risks. You are responsible for conducting your own due diligence and assessing the suitability of any caretaker.

10. Account Termination & Suspension

We reserve the right to terminate or suspend your account immediately and without notice if:

• You violate these Terms & Conditions
• You engage in fraudulent or illegal activity
• You harass or abuse other users
• You provide false information
• We determine your account poses a risk to our platform or other users

Upon termination, your right to use the platform ceases immediately. We may retain your data as required by law.

11. Dispute Resolution & Grievance Redressal

In case of disputes between users or regarding services:

• We will investigate and attempt to resolve within 7 business days
• If unresolved, disputes may be escalated to management
• Both parties agree to attempt resolution through our platform before pursuing legal action

12. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of India. You agree to submit to the exclusive jurisdiction of the courts located in India for any disputes arising from these terms or your use of the platform.

13. Modifications to Terms

Testus reserves the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting to the platform. Your continued use of the platform constitutes acceptance of the modified terms. We recommend reviewing these terms periodically for updates.

14. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms & Conditions, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Testus regarding your use of the platform and supersede all prior agreements and understandings.
